New York's dog bite law can be found in the New York Agriculture & Markets Code section 123. This statute states that dog owners are strictly liable for any medical expenses that result from their dog's actions. This law applies even if the owner has taken measures to secure the dog.
Note that this law only applies to medical expenses. If the injury is especially serious and the victim wants to recover additional damages, such as lost wages or property damage, then it must be demonstrated that the dog owner was negligent.
Examples of dog owner negligence include:
- Not properly securing a dog in a yard or pen
- Not properly warning visitors of a dangerous dog
- Not properly leashing a dog in public
If you believe that any of these conditions contributed to your dog bite or dog-related injury, then our firm is ready to speak with you. We can thoroughly examine the circumstances of your case and, if necessary, aggressively pursue the financial relief you or your loved one deserve.
